Austin lawyer Adam Pugh and his wife Jennifer Pugh and remodeler Tonya Nieto settled out of court after stipulating that neither side committed the causes of action alleged by the other. The parties both agreed to pay their own cost and legal fees with Travis County's 250th District Court approving of their final take-nothing judgement.
Both sides had differing accounts of the case but eventually agreed that neither side had committed a crime against the other:
"In the agreed judgment, the parties stipulated that both the Pughs and Nieto and her company did not: breach their contract or their fiduciary duties; violate the Texas Theft Liability Act or the Texas Trust Fund Act; commit fraud, conversion or civil conspiracy; or become unjustly enriched."
